These Terms of Service ("Terms") are a binding agreement between you and Botifex LLC ("Botifex," "we," "us," or "our") governing your use of the Botifex website, applications, browser extension, and related services (collectively, the "Service").
By accessing or using the Service, creating an account, or checking a box to accept these Terms, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
By creating an account, starting a subscription, or otherwise using the Service, you also represent that you meet the eligibility requirements in Section 4.2.
Botifex is a web-based reselling platform and set of tools that help users discover marketplace opportunities, manage inventory, prepare listings, and use related reseller workflows. In addition to aggregating information from third-party websites, the Service may allow you to create an account, upload content, connect optional integrations, and interact with other users. Features may vary by plan, availability, marketplace support, and technical feasibility. We may add, modify, or discontinue features over time. Some information displayed in the Service comes from third-party sources and is not User Content (see Section 3). Other material is created or uploaded by users and is governed by Section 6. Marketplace integrations and automated actions are governed by Section 5.
This tool accesses and displays information from third-party websites solely for the convenience of its users. The operators of this application make no claim of ownership over such data and provide no guarantee of availability or accuracy.

We do not verify the accuracy of information obtained from third-party sources. Listings, prices, availability, and other information may be outdated, incorrect, or incomplete. Users should always verify information directly with the source website before making any decisions or transactions.
Botifex is not affiliated with, endorsed by, or sponsored by Facebook, Meta, eBay, Craigslist, KSL, Mercari, OfferUp, Poshmark, or any other marketplace. Trademarks and logos belong to their respective owners. You are responsible for complying with each platform's terms, policies, and applicable laws when using our Service or extension.
Botifex may rely on independent third-party services to operate the Service, including marketplaces, payment processors, communications providers, hosting and infrastructure providers, analytics providers, AI providers, APIs, and browser or extension infrastructure. Those providers may have their own terms, privacy policies, availability limits, rate limits, authentication requirements, and outages. Botifex does not control third-party services and is not responsible for their acts, omissions, changes, or interruptions, except to the extent applicable law provides otherwise. Your use of a third-party service may also be subject to that third party's terms.
Users are solely responsible for ensuring that any data access or use complies with the terms of service of each respective website. You agree to:
The Service is intended only for adults. You must be at least 18 years old, or the age of majority in your jurisdiction if that age is higher, to create a Botifex account, subscribe, make payments, submit User Content, or otherwise use the Service. You may not create or use a Botifex account if you do not meet this requirement. By creating an account, starting a subscription, or using the Service, you represent and warrant that you meet this age requirement and that any information you provide is truthful.

Some features allow you to connect marketplace accounts, provide session credentials or similar access materials where supported, authorize a browser extension, or otherwise initiate actions through Botifex. When you do so:
Botifex may provide tools that assist you in discovering, preparing, managing, or publishing listings to third-party marketplaces. These tools may use browser extensions, integrations, APIs, optional credentials you supply, automation, or other technical mechanisms, and may evolve as we add or change marketplace support.
When you use marketplace-related features:
Botifex does not guarantee that a third-party marketplace will accept, publish, display, maintain, or preserve a listing. Third-party marketplaces may change their APIs, interfaces, policies, authentication requirements, rate limits, availability, or other technical requirements at any time. As a result, Botifex may lose, modify, delay, or discontinue related functionality without being responsible for those third-party changes.
Except to the extent applicable law provides otherwise, Botifex is not responsible for marketplace suspensions, restrictions, removals, bans, account actions, fees, chargebacks, buyer or seller disputes, or other consequences resulting from your activity on a third-party marketplace—whether that activity was assisted by Botifex tools or performed by you manually.
You must comply with each marketplace's applicable Terms of Service, policies, and rules. You may not use Botifex to:
This section applies to content you or other users submit, post, upload, or make available through the Service ("User Content"). User Content includes, without limitation: profile information and media; inventory photos and descriptions; messages, reactions, and attachments in direct messages or community channels; server names, banners, and icons; wishlist and listing notes; reports; and any other material you provide that is not sourced automatically from third-party marketplaces.
You retain ownership of User Content you create, subject to the rights you grant below. By submitting User Content, you grant Botifex a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, process, reproduce, modify formatting, resize images, generate thumbnails, back up, transmit, display, and otherwise use your User Content solely as reasonably necessary to operate, provide, secure, and improve the Service—including delivering content to users you authorize to see it and maintaining reliability and security. This license is limited to Service operation and improvement; it is not a broad right to use your User Content for unrelated advertising or promotional campaigns.
This license continues for as long as your User Content remains on the Service and for a reasonable period afterward as needed for backups, legal compliance, dispute resolution, and enforcement of these Terms. If you delete User Content or your account, we will make reasonable efforts to remove it from active systems, but copies may persist in backups for a limited time.
When you submit User Content, you represent and warrant that:
Depending on the feature you use, User Content may be visible to you only, to specific users (for example, direct messages), or to members of a community server. You are responsible for choosing appropriate privacy and sharing settings. Botifex is not responsible for how other users copy, screenshot, or reuse content you make available to them outside the Service.
You may not upload, post, or share User Content that:
We may update these standards as the Service evolves. Server owners and moderators may adopt additional rules for their communities, provided they do not conflict with these Terms.
We do not pre-screen all User Content and are not obligated to monitor the Service. However, we and our designees (including community moderators acting within tools we provide) may, at any time and without prior notice:
We are not liable for any failure to remove specific content, for actions taken in good faith to enforce these Terms, or for decisions made by community moderators. Moderators act on behalf of their communities; Botifex may intervene in serious or platform-wide matters.
If you believe User Content violates these Terms or your rights, use in-app reporting where available or contact us at Support@Botifex.com with enough detail for us to locate the content (URLs, usernames, server name, screenshots, and description of the issue). We will review reports in good faith but cannot guarantee outcomes or response times.
Botifex respects intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to our designated copyright agent at Legal@Botifex.com with the subject line "DMCA Notice" including:
We may remove or disable access to allegedly infringing material and notify the user who posted it. Users may submit a counter-notification if they believe removal was mistaken; we will provide further instructions when applicable. We may terminate accounts of repeat infringers in appropriate circumstances.
Some features analyze content you upload or select (for example, inventory photos, listing text, or Botifex Vision scans) using automated or AI-assisted tools (including providers such as Google Cloud Vision and OpenAI) to suggest titles, categories, product identity, descriptions, recommendations, deal insights, or market-value estimates. Estimates may rely on third-party marketplace data that is incomplete or imperfect.
AI-generated results may be inaccurate, incomplete, or unsuitable for a particular transaction. AI-generated pricing, identification, descriptions, recommendations, and other outputs are suggestions only and are not guarantees of accuracy, profitability, legal compliance, or market performance. You are responsible for reviewing AI-generated information before relying on it, and you remain responsible for final listings and business decisions. You consent to this processing for Service delivery and, where you opt in, to limited retention of training features as described in the Privacy Policy. Everyday history delete soft-hides scans; verified erasure / account purge permanently removes your Vision photos and related personal data.
We may impose limits on file size, number of uploads, message length, and storage. Only image uploads are permitted where the Service specifies image media. We may reject or remove files that exceed limits, use unsupported formats, or fail security checks.
The developers of this application disclaim any liability arising from:
To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months prior to the event giving rise to the claim, or $100 USD, whichever is less.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTIFEX AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
EXCEPT AS EXPRESSLY STATED IN WRITING BY BOTIFEX, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES; IN THOSE CASES, THE ABOVE EXCLUSIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
You agree to indemnify, defend, and hold harmless Botifex, its operators, developers, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
Paid plans may include Basic (Standard), Pro, and Ultra tiers, each with different features, platform access, and limits described on our pricing pages. Free tiers may have limited functionality. We may change plans, pricing, or features with reasonable notice; changes apply to future billing periods unless otherwise required by law. You must meet the eligibility requirements in Section 4.2 to subscribe or make payments.
Payments are processed by Stripe. You agree to Stripe's terms and privacy practices for checkout. We do not store full payment card numbers on our servers. Taxes may apply based on your location.
Basic and Pro plans may include a 7-day free trial when offered at signup. Ultra does not include a free trial. Unless you cancel before the trial ends, your subscription converts to a paid plan and you will be charged at the then-current rate for the billing cycle you selected (monthly or annual). Trial eligibility and payment-method requirements are shown at checkout.
You may cancel a paid subscription at any time through the Stripe Customer Portal or account billing settings where available. Cancellation stops future automatic renewals. You retain access to paid features through the end of the current paid billing period that you have already paid for. After that period ends, paid features end and your account continues on the free tier (or without premium entitlements), unless you resubscribe. Unused time in a billing period is not refunded, and cancellation does not create a right to a refund, except where required by applicable law.
SMS notifications are available on eligible paid plans when you provide a phone number and consent. Message frequency varies. Message and data rates may apply. Reply STOP to opt out. See our Privacy Policy for details.

The Service itself—including its software, design, branding, documentation, and original materials created by Botifex LLC—is owned by Botifex and protected by copyright, trademark, and other intellectual property laws. Third-party marketplace data displayed in the Service remains subject to the rights of its respective sources (see Section 3).
You may not:
Except for the license you grant in Section 6.1, we do not claim ownership of your User Content. If you provide suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without compensation or attribution.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to:
Details about browser extension data, marketplace credentials or tokens, AI processing, payments, communications, account deletion, and retention are described in the Privacy Policy. If these Terms and the Privacy Policy conflict on a privacy topic, the Privacy Policy controls for that topic.
You may cancel your subscription as described in Section 8. To delete your account and personal data, email Support@Botifex.com or privacy@botifex.com from your registered email address. We will verify your identity before processing deletion.
We may suspend or terminate your account, access, or use of particular features at any time if we reasonably believe it is necessary to protect Botifex, other users, third parties, or the integrity of the Service. We may do so immediately, with or without prior notice, for serious issues such as:
For other violations or risk issues, we may take appropriate action, including warnings, feature restrictions, suspension, or termination, with or without notice as circumstances warrant. We also reserve the right to discontinue the Service or particular features, in whole or in part, as described elsewhere in these Terms.

These Terms are governed by the laws of the State of Idaho, United States, without regard to conflict-of-law rules, except that mandatory consumer protection laws in your home jurisdiction may apply where required.
Before filing a claim, you agree to contact us at Legal@Botifex.com and allow at least 30 days to resolve the dispute informally.
Except for disputes that qualify for small-claims court or injunctive relief for intellectual property or unauthorized access, any dispute arising from these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, as modified by this section. Arbitration will take place in Ada County, Idaho, or remotely as the arbitrator allows. The arbitrator may award the same damages a court could award on an individual basis.
YOU AND BOTIFEX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. If this waiver is found unenforceable, the arbitration agreement is void as to you.
You may opt out of arbitration within 30 days of first accepting these Terms by emailing Legal@Botifex.com with subject line "Arbitration Opt-Out," your name, and the email associated with your account.
These Terms and the Privacy Policy constitute the entire agreement between you and Botifex regarding the Service and supersede prior agreements on the same subject.
You consent to receive communications electronically (email, in-app notices, SMS where enabled). Marketing emails include an unsubscribe option where required by law. Transactional messages about your account may still be sent.
We are not liable for delays or failures caused by events beyond our reasonable control, including outages, acts of God, labor disputes, or third-party platform changes.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without restriction.
If you apply to or participate in the Botifex Creator / Affiliate Program, the Creator / Affiliate Program Terms also apply and control if they conflict with these Terms on program-specific subjects (commission, attribution, promotional content, and payouts).
